Terms of Service

Welcome to Urbanity Real Estate Management Inc (“we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile app, and property management services (collectively, the “Platform”). By using our Platform, you agree to comply with these Terms.

If you do not agree, please do not use our services.

1. Who We Are

Urbanity Real Estate Management Inc is a property management company based in Montreal, Quebec. Our Platform provides tools for tenants, property managers, real estate agents, and subcontractors to manage rentals, payments, documents, maintenance requests, and scheduling in a centralized, secure system.

2. Acceptance of Terms

By accessing or using our Platform, you confirm that you:

Are at least 18 years old or have reached the age of majority in your province;
Have the legal capacity to enter into this agreement;
Agree to comply with these Terms and all applicable laws.

3. Services Provided

Our Platform offers:

Online rent and payment processing
Secure access to leases, contracts, and property documents
Maintenance request submission and tracking
Financial dashboards and KPI insights for property managers
Real-time scheduling of inspections and property visits
Seamless collaboration with real estate agents and subcontractors

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.

4. User Accounts

To access certain features, you must create an account. You agree to:

Provide accurate and complete information;
Keep your login credentials secure;
Notify us immediately of any unauthorized access or breach;
Be fully responsible for activities under your account.

We are not liable for any loss or damage resulting from unauthorized use of your account.

5. Payments and Fees

Tenants can make rent and other payments directly through the app.
Property managers and owners can track income, expenses, and outstanding balances.
We use secure third-party payment processors.
By using the Platform, you authorize us and our payment partners to process your transactions.
We are not responsible for bank errors, declined transactions, or fees charged by your financial institution.

6.Tenant and Property Manager Responsibilities

For Tenants:

Ensure timely payment of rent and other agreed fees.
Provide accurate personal and financial information when required.
Submit maintenance requests responsibly, with accurate descriptions of the issue.

For Property Managers / Owners:

Provide correct property data, lease details, and tenant records.
Approve or reject maintenance quotes and work orders in a timely manner.
Comply with applicable landlord-tenant laws, including the Tribunal administratif du logement (TAL) regulations in Quebec.

7. Subcontractors and Service Providers

Subcontractors receive maintenance requests via the Platform and provide quotes directly.
Work performed, deadlines, and quality remain the sole responsibility of the subcontractor.
Urbanity Real Estate Management Inc is not responsible for delays, workmanship issues, or disputes arising between property managers, tenants, and subcontractors.

8. Real Estate Agents

Agents can access property availability, schedule visits, and submit tenant applications through the Platform.
Urem does not guarantee rental approvals or property availability at any specific time.
Final decisions on tenant acceptance remain at the sole discretion of property managers or owners.

9. Data Protection and Privacy

Your personal information is collected, stored, and processed according to our Privacy Policy:

By using the Platform, you acknowledge and consent to our handling of personal data in compliance with Quebec’s Law 25 and PIPEDA.

10. Acceptable Use Policy

You agree not to:

Use the Platform for fraudulent, abusive, or illegal activities;
Misrepresent your identity, ownership, or rights;
Attempt to bypass security systems or exploit vulnerabilities;
Upload viruses, malware, or malicious code;
Collect or use data from the Platform without authorization.

Violations may result in suspension or termination of your account and possible legal action.

11. Limitation of Liability

To the fullest extent permitted by law:

Urbanity Real Estate Management Inc is not liable for indirect, incidental, or consequential damages resulting from your use of the Platform.
We make no warranties regarding uninterrupted availability, data accuracy, or specific outcomes.
Property disputes, unpaid rents, subcontractor delays, and maintenance quality remain the responsibility of the parties involved.

12. Indemnification

You agree to indemnify and hold harmless Urem, its directors, employees, and partners against any claims, damages, liabilities, or expenses arising from:

Your breach of these Terms;
Your misuse of the Platform;
Disputes between you and other users (tenants, managers, subcontractors, or agents).

13. Service Interruptions

While we strive for continuous uptime, we cannot guarantee the Platform will be free from interruptions, errors, or downtime.
We are not liable for delays, data loss, or financial damages caused by system outages or third-party service failures.

14. Governing Law

These Terms are governed by the laws of Quebec and applicable Canadian federal laws.
Any disputes arising from these Terms or your use of the Platform will be resolved in the appropriate courts of Quebec, Canada.

15. Changes to These Terms

We may modify these Terms from time to time to reflect legal updates or service changes.
When we do, we will update the Effective Date at the top.
By continuing to use the Platform, you agree to the revised Terms.
